Changes in Ordering Copies Of Birth And Death Records
Because of the increase in cases of identity theft, California passed new laws to protect your official birth and death records. These laws went into effect, July 1, 2003. They changed the way you get a copy of a birth or death record.

  • What are the changes in the law? - Starting July 1, 2003, there are two kinds of records provided, an authorized copy to establish identity and an informational copy.

  • What's the difference in the two records? - The authorized certified copy can be used to prove identity, and is only given to someone authorized to receive it. The informational certified copy is for information only and cannot be used to prove identity. It will be labeled "INFORMATIONAL, NOT A VALID DOCUMENT TO ESTABLISH IDENTITY."

  • Who can get an authorized certified copy of a record? - A person authorized to get a certified copy of a birth or death record must be one of the following:
    • The registrant or a parent or legal guardian of the registrant.
    • A party entitled to receive the record as a result of a court order, or an attorney or a licensed adoption agency seeking the birth record in order to comply with the requirements of Section 3140 or 7603 of the Family Code.
    • A member of a law enforcement agency or a representative of another governmental agency, as provided by law, who is conducting official business.
    • A child, grandparent, grandchild, sibling, spouse, or domestic partner of the registrant.
    • An attorney representing the registrant's estate, or any person or agency empowered by statue or appointed by a court to act on behalf of the registrant or the registrant's estate.
    • A funeral director ordering certified copies of a death certificate on behalf of an individual specified in paragraphs (1) to (5), inclusive, of subdivision (a) of Section 7100 of the Health and Safety Code.
