NO CHARGES FILED IN CONNECTION WITH AN ASSAULT AT SUN CITY LINCOLN HILLS
The District Attorney’s Office announced today that no charges will be filed in connection with an assault that occurred in Sun City Lincoln Hills on February 8th, 2016. The case was submitted to our office by the Lincoln Police Department for our review to determine if any criminal charges were warranted in the case.
The reports indicate that two citizens were in separate vehicles driving towards Sun City Lincoln Hills when there was a verbal confrontation concerning traffic laws. When one citizen stopped to check his mailbox, the dispute continued onto the sidewalk. A physical altercation ensued and both citizens fell to the ground.
As they both fell off the curb, one citizen sustained injuries to both of his ankles, including a compound fracture. The other citizen sustained injuries to his elbows and knees. That citizen then left the scene, while the other was assisted by a neighbor and called the police. Once that citizen was transported to the hospital, he provided a statement to law enforcement, but was unable to identify the other party. Once Sun City Lincoln Hills issued a Neighborhood Watch Alert, the second party came forward to identify himself. He provided a statement and supporting documentation, detailing the circumstances surrounding the altercation.
In order to be convicted of an assault, the District Attorney’s Office must prove beyond a reasonable doubt that one individual attacked another. We must also prove beyond a reasonable doubt the suspect was not acting in self-defense. We cannot prove either beyond a reasonable doubt in this case. Based on the information provided to our office, there is insufficient evidence to determine who the initial aggressor was and who should be held responsible for the altercation. Accordingly, no criminal charges will be filed against either party.
