AUBURN MAN WHO EXPOSED HIMSELF IN PARK RECEIVES
90 DAYS IN JAIL AND MUST REGISTER AS SEX OFFENDER
A Placer County trial jury deliberated just 30 minutes Thursday before finding an Auburn man guilty of indecently exposing himself at a park last year, and today a judge sentenced him to 90 days in jail and ordered him to register as a sex offender.
The decisions were made in the misdemeanor case of Dirk Foehr, 45, who was also placed on formal probation for four years by Placer County Superior Court Judge Larry D. Gaddis.
“Serious consequences for his conduct are appropriate,” prosecutor Carl Mayhew of the Placer County District Attorney’s Office said after the sentencing. “This defendant has to register as a sex offender.”
During a two-day trial this week in Placer County Superior Court, the jury determined that it was Foehr who was sitting naked in a parked car at Auburn Regional Park on March 24, 2009, and who was observed by a woman walking past the vehicle.
Foehr’s attorney contended during the trial that his client had been jogging and was changing his clothes inside the vehicle.
Before imposing sentence, Judge Gaddis said Foehr’s behavior painted “a disturbing picture.”
“This is a serious offense that offends people in the community,” he said.
Among other conditions in the sentencing are that Foehr must attend any counseling programs ordered by the county Probation Department and that he cannot have contact with any of the witnesses who testified in his trial. In addition, he must pay fees and restitution fines totaling more than $1,600.
