4.    COMMUNITY DEVELOPMENT RESOURCE AGENCY

A.    Final Action of Appeal of Planning Commission’s Denial of the Sorensen Variance (PLN21-00460)

1.    Take final action on the appeal filed by Sven Sorensen consistent with the tentative action taken previously by the Board on July 12, 2022.

2.    Find the project categorically exempt from the California Environmental Quality Act pursuant to Section 15303 of the California Environmental Quality Act Guidelines and Section 18.36.050 of the Placer County Environmental Review Ordinance (New Construction or Conversion of Small Structures).

3.    Finalize the tentative action taken on July 12, 2022 to uphold the appeal and approve the Variances to allow an existing shop to be set 3.74 feet from the north property line and a 0-foot setback for a 9-foot retaining wall on the north property line where 30 feet is normally required, subject to the findings and Conditions of Approval contained herein.

A.    8810 Cook Riolo Road - Annexation to County Service Area 28, Zone of Benefit 173 – Dry Creek

1.    Conduct a public hearing to hear and consider protests, if any, to the annexation of 8810 Cook Riolo Road, located at the end of the southwest corner of Almond Blossom Lane and Cook Riolo Road, Roseville (APN 023-240-039-000), into the boundaries of County Service Area 28, Zone of Benefit 173 – Dry Creek to provide sewer service, and determine whether written protests to the annexation have been received from a majority of property owners who own more than 50 percent of the assessed value of all taxable property in the proposed zone.

2.    Adopt a Resolution annexing 8810 Cook Riolo Road, APN 023-240-039-000, into County Service Area 28, Zone of Benefit 173-Dry Creek.

6.    COMMUNITY DEVELOPMENT RESOURCE AGENCY

A.    Placer Ranch Specific Plan Agreement Regarding the Dedication of Land In-Lieu of Mitigation Fees

1.    Approve and Authorize the Chairperson or designee to execute the Agreement Regarding the Dedication of Land In-Lieu of Mitigation Fees between the County of Placer, the Placer County Conversation Authority and JEN CA Placer Ranch, LLC, a California Limited Liability Company for the Placer Ranch Specific Plan to mitigate impacts through combination of payment to Placer County Conversation Program fees and dedication of land and authorize the Chairperson to execute any amendments to the agreement, including but not limited to allocation of additional credits for subsequent phases of the Placer Ranch project, subject to Risk Management and County Counsel concurrence.

A.    Placer County Mental Health Services Act Annual Update and Expenditure Plan

1.    Adopt the Placer County Mental Health Services Act Plan Annual Update for FY 2022-2023, which includes the FY 2017-2021 Prevention and Early Intervention Evaluation Report and the Final Report for Homeless Integrated Care Coordination and Evaluation Innovation Project.

2.    Approve the Expenditure Plan for FY 2022-2023 in the amount $24,092,918.

1.    Conduct a Public Hearing and adopt a Resolution adopting the Final Budget for FY2022-23 for the Placer Vineyards Park and Recreation District.

9.    COMMUNITY DEVELOPMENT RESOURCE AGENCY

A.    Appeal of the Planning Commission’s Denial of the 3M Event Center Conditional Use Permit (PLN22-00053)

1.    Conduct a Public Hearing to consider an appeal filed by the property owner, Gus Mathiopoulos on behalf of Mathiopoulos 3M Family LP.

2.    Deny the appeal filed by the property owner, Gus Mathiopoulos.

3.    Uphold the Planning Commission’s June 9, 2022 decision to deny the 3M Event Center Conditional Use Permit (PLN22-00053).

4.    Find that the project is statutorily exempt from environmental review pursuant to provisions of Section 15270 of the California Environmental Quality Act Guidelines and Section 18.36.010 (G) of the Placer County Environmental Review Ordinance (Projects which are disapproved).

10.  TREASURER-TAX COLLECTOR

A.    Post Retirement Employment Resolution

1.    Adopt a Resolution authorizing the Treasurer-Tax Collector’s Office to offer Diane Handy post-retirement employment prior to the California Public Employees’ Retirement System required 180 days wait period.

 

11.  FACILITIES MANAGEMENT

A.    New Health and Human Services Center at Placer County Government Center - Change Order Approval and Authorization with Turner Construction Company

1.    Approve Change Order No. 2 to Construction Contract, SCN103790, with Turner Construction Company for the Health and Human Services Center project, PJ00113, in the amount of $473,338 resulting in a new total contract amount of $80,263,115 to address unforeseen conditions and delegate authority to the Director of Facilities Management, or designee, to approve any necessary additional change orders in an amount not to exceed $210,000 consistent with Section 20142 of the Public Contract Code.

 

12.  HEALTH AND HUMAN SERVICES

A.    Behavioral Health Urgent Care Center Services - Contract with North Valley Behavioral Health

1.    Approve an agreement with North Valley Behavioral Health for behavioral health urgent care center services, in an amount not to exceed $1,285,560 from September 1, 2022, through August 31, 2023, and authorize the Director of Health and Human Services to execute the agreement with Risk Management and County Counsel concurrence and to sign subsequent amendments up to $100,000 consistent with the subject matter and scope of work with Risk Management and County Counsel concurrence.

 

13.  HUMAN RESOURCES

A.    Amendments to Recruitment and Benefit Policies

1.    Introduce a codified Ordinance, waive oral reading, to amend various sections of Chapter 3 of the Placer County Code relating to recruitment and benefit policies.

2.    Introduce an uncodified Ordinance, waive oral reading, clarifying the opt-out feature in the Cafeteria Plan benefit.

 

14.  PROCUREMENT

A.    Fleet Card Fuel Services – U.S. Bank National Association

1.    Approve an increase to SCN103888 with U.S. Bank National Association of Minneapolis, MN for credit card fuel purchases in the amount of $150,000 for a new total amount of $1,650,000 through September 7, 2022.

2.    Approve the renewal of SCN103888 with U.S. Bank National Association of Minneapolis, MN based on a competitively awarded cooperative contract for credit card fuel purchases as needed in the amount of $2,000,000 for the period of September 8, 2022 through September 7, 2023.

3.    Approve the option to renew the agreement on a year-to-year basis for two (2) additional one-year periods in a maximum amount of $2,000,000 annually.

4.    Authorize change orders up to a cumulative amount of $200,000 consistent with the Placer County Procurement Policy.

5.    Authorize the Purchasing Manager to sign all required documents subject to departmental concurrence and available funding.

 

15.  PUBLIC WORKS

A.    Alta Forestry Road Slope Stabilization Project - Approve Plans and Specifications and Authorization to Advertise, Delegate Authority to Award and Execute Construction Contract and Delegate Authority to Award and Execute Construction Management Services Contract

1.    Approve the plans and specifications for the Alta Forestry Road Slope Stabilization Project, Project No. PJ01002, and authorize the Director of Public Works, or designee, to advertise for construction bids.

2.    Authorize the Director of Public Works, or designee to award and execute a construction contract for the Alta Forestry Road Slope Stabilization Project to the lowest responsible and responsive bidder, upon Risk Management and County Counsel concurrence, for an amount not to exceed $2,000,000 and to execute changes to the contract up to $112,500 consistent with Public Contract Code Section 20142 and the County Procurement Policy Manual.

3.    Authorize the Director of Public Works, or designee, to award and execute a construction management, inspection, and material testing services contract for the Alta Forestry Road Slope Stabilization Project, upon Risk Management and County Counsel concurrence, for an amount not to exceed $200,000 and to execute changes to the contract up to $20,000 consistent with Public Contract Code Section 20142 and the County Procurement Policy Manual.

 

B.    2022 Hot Mix Asphalt Overlay and Surface Treatment Project - Award Construction Contract to All-American Construction Inc.

1.    Approve the award of Construction Contract No. 001304 to the lowest responsive and responsible bidder, All-American Construction Inc., of Live Oak, CA for the construction of the 2022 Hot Mix Asphalt Overlay and Surface Treatment Project in the amount of $3,095,546 and authorize the Chair to execute the contract.

2.    Authorize the Director of Public Works, or designee, to execute changes to the contract up to $167,277 consistent with Public Contract Code Section 20142 and the County Procurement Policy Manual.

1.    Adopt a Resolution authorizing the Agricultural Commissioner to sign Agreement No. 22-0294-038-SF with the California Department of Food and Agriculture for reimbursement of County costs up to a maximum of $135,109 for enforcement of the mandated Asian Citrus Psyllid Trapping Program from October 1, 2022, to September 30, 2023.

2.    Authorize the Faithful Performance and Labor and Materials sureties to be set at:

a.    Faithful Performance - 10 percent of the value of any otherwise unsecured public improvements immediately upon the Board of Supervisors’ approval.

b.    Labor and Material - 50 percent of the total estimated cost of the accepted public improvements, and in conformance with Government Code Section 66499.7.

1.    Adopt findings to continue authorization of teleconference attendance for members of County committees and commissions pursuant to Assembly Bill 361 as codified in Government Code section 54953.

 

B.    2021-22 Placer County Grand Jury Final Report Responses

1.    Approve and authorize the chair to execute letters in response to the Placer County Grand Jury’s 2021-22 Final Report.

A.    Grant Easement Deed and Right of Way to Pacific Gas & Electric, a California Corporation - Griffith Quarry Park, Penryn CA

1.    Adopt a Resolution to approve a Pacific Gas & Electric Company utility easement in the southern portion of the Placer County Griffith Quarry Park property, APN 032-195-004-000, located at 7405 Rock Springs Road, Penryn, CA, and authorize the Director of Facilities Management, or designee, to take all necessary actions to execute, grant, and record an Easement Deed with the Pacific Gas & Electric Company for a utility easement.

 

25.  HEALTH AND HUMAN SERVICES

A.    Reappointment to the Mental Health, Alcohol and Drug Advisory Board

1.    Approve the reappointment of Geoffrey McLennan, Family Member, District 3, Seat 11 to the Mental Health, Alcohol and Drug Advisory Board.

 

B.    Memorandum of Understanding with the California Department of State Hospitals

1.    Approve a Memorandum of Understanding with the California Department of State Hospitals, California Mental Health Services Authority (CalMHSA), and participating counties for the purchase of state hospital beds for participating counties extending the term by six months from July 1, 2022 to December 31, 2022, and authorize payments made to date, and authorize the Director of Health and Human Services to sign the amendment with Risk Management and County Counsel concurrence and subsequent amendments consistent with the subject matter and scope of work with Risk Management and County Counsel concurrence.

2.    Approve a Participation Agreement with CalMHSA for their State Hospital Programs from July 1, 2022 through June 30, 2023, in an amount not to exceed $2,804, and authorize payments made to date, and authorize the Director of Health and Human Services to sign the amendment with Risk Management and County Counsel concurrence and subsequent amendments consistent with the subject matter and scope of work with Risk Management and County Counsel concurrence.

 

C.    Agreement with the State Department of Health Care Services for Mental Health Managed Care Program

1.    Adopt a Resolution authorizing the Director of Health and Human Services to sign the Department of Health Care Services agreement for the Placer County Mental Health Plan to provide or arrange for the provision of specialty mental health services to eligible Medi-Cal beneficiaries for a five-year period beginning July 1, 2022 through June 30, 2027, with Risk Management and County Counsel concurrence, and to sign related documentation and subsequent amendments consistent with the agreement’s subject matter and scope of work with Risk Management and County Counsel concurrence.

 

D.    California Department of Public Health Nutrition Education and Obesity Prevention Amendment

1.    Adopt a Resolution authorizing the Director of Health and Human Services to sign an amendment with the California Department of Public Health for the operation of the Nutrition Education and Obesity Prevention Program, to increase funding by $276,519 for a new total amount not to exceed $1,106,076, and to extend the term an additional year for revised term of October 1, 2019 through September 30, 2023, with Risk Management and County Counsel concurrence, and to sign related documentation and subsequent amendments up to $100,000 consistent with the agreement’s subject matter and scope of work with Risk Management and County Counsel concurrence.

 

26.  HUMAN RESOURCES

A.    Placer Public Employees Organization Side Letter Agreement regarding Tahoe Branch Assignment Premium

1.    Approve a side letter agreement between the County and the Placer Public Employees Organization to update the current Memorandum of Understanding regarding Tahoe Branch Assignment Premium. 

 

27.  PARKS AND OPEN SPACE

A.    Tahoe City Public Utility District - Maintenance Service Agreement

1.    Approve an Agreement with the Tahoe City Public Utility District for parks and grounds maintenance services in the Tahoe City area for the period of July 1, 2022 to June 30, 2027 in the base annual amount of $281,969, subject to a consumer price index adjustment, and authorize a single one-year extension from July 1, 2027 to June 30, 2028.

2.    Approve ratification of payment for services provided in FY 2021-22 in an amount not to exceed $51,010.

3.    Authorize the Purchasing Manager to sign the Agreement, the one-year extension and any other required documents.

 

28.  PROCUREMENT - In accordance with County Policy, non-contested competitively awarded bids under $400,000 are placed on the Consent Agenda.

 

A.    Specimen Collection Services – Increase Contract with Valley Toxicology Inc.

1.    Approve an increase to a contract with Valley Toxicology Inc. of West Sacramento for Specimen Collection Services for Drug Testing Services in the amount of $15,000 for a revised total of $279,000 through June 30, 2022.

2.    Authorize the Purchasing Manager to sign all required documents.

 

B.    Legal Book Online Subscription - Thomson Reuters Elite

1.    Approve the renewal of a five-year agreement with West Publishing Corporation doing business as Thomson Reuters Enterprise Center GmbH (“Thomson Reuters”) for online research services in the aggregate amount not-to­ exceed $105,943.30 over the five-year period of the contract beginning the date the contract is executed and authorize the Purchasing Manager to sign all required documents subject to County Counsel concurrence, and to execute amendments up to $10,594 consistent with the subject matter and scope of work.

 

29.  PUBLIC WORKS

A.    2021 Roadway Surface Treatment Project - Contract Change Orders to Pavement Coatings Co

1.    Ratify contract change order number five (CCO#5) and increase the total authorization of the Director of Public Works, or designee, to execute construction Contract Change Orders to existing Contract No. 1268 with Pavement Coatings Co. from $111,958 to $300,000 for a total potential contract amount not to exceed $2,289,171.

2.    Authorize the Director of Public Works, or designee, to execute an amendment to the cooperative work agreement with the Town of Loomis, increasing the agreement amount from $100,000 to $200,000, with County Counsel and Risk Management approval to reimburse the County for work performed under this contract within the Town of Loomis.

 

B.    Placer Vineyards Specific Plan Property 1A Traffic Fee Credit/Reimbursement for Walerga Road Agreement - Placer County and Lennar Homes of California, LLC.

1.    Approve a Traffic Fee Credit/Reimbursement Agreement with Lennar Homes of California, LLC. for improvements to Walerga Road and the intersection of Walerga Road and Town Center Avenue as part of Placer Vineyards Specific Plan Property 1A included in the Dry Creek District of the Capital Improvement Program and Countywide Traffic Fee Program constructed as part of the Placer Vineyards Specific Plan (PLN17-00265), and authorize the Director of Public Works, or designee to sign the agreement.

 

30.  REVENUE SHARINGIn approving the following appropriations, the Placer County Board of Supervisors makes the finding that each and every approved contribution serves a public purpose by promoting the general welfare of the County and its inhabitants; therefore, the County benefits.

 

A.    The Gathering Inn

1.    Approve appropriation of $3,750 in Revenue Sharing monies to The Gathering Inn, Gathering for Hope 2022 event as requested by Supervisor Gore ($1,000), Supervisor Weygandt ($250), Supervisor Holmes ($1,000), Supervisor Jones ($500), and Supervisor Gustafson ($1,000).

 

B.    Placer Land Trust

1.    Approve appropriation of $3,000 in Revenue Sharing monies to Placer Land Trust Annual Conservator Awards Event as requested by Supervisor Gore ($500), Supervisor Weygandt ($500), Supervisor Holmes ($500), Supervisor Jones ($500), and Supervisor Gustafson ($1,000).

A.    Commendation of Lieutenant John Savage

1.    Approve a Commendation for Lieutenant John Savage for over thirty years of dedicated public service as a full-time employee of the Placer County Sheriff’s Office.

Materials related to an item on this Agenda submitted to the Board after distribution of the agenda packet are available for public inspection at the Clerk of the Board of Supervisors Office, 175 Fulweiler Avenue, Auburn, during normal business hours.  Placer County is committed to ensuring that persons with disabilities are provided the resources to participate fully in its public meetings. Any document submitted for consideration shall be submitted to the Clerk of the Board of Supervisors, 175 Fulweiler Avenue, Auburn, CA 95603 no later than 5:00 p.m. the day before the scheduled meeting.  Any documentation submitted at any noticed videoconferencing site will become part of the official record, but will not be disseminated to the Board prior to the Board’s action.  NOTE: An alternate location may be offered as a courtesy for a Board meeting but may be closed due to inclement weather or may not be available if technology fails.

The public’s participation in the Board of Supervisors meeting will be received through the following means: 

 

·         The board meeting room will be open to in-person attendance.

·         The Board proceedings are available via Zoom and you may also participate in Public Comment by using the “raise hand” function https://www.placer.ca.gov/boslive

·         You may call in to listen toll free at 877-853-5247 using the Webinar ID 978 5999 5398.

·         Alternatively, citizens may submit their comments in written form at the following link: https://www.placer.ca.gov/FormCenter/Clerk-of-the-Board-29/Public-Comment-Submission-157.

·         The public may always email comments to the Clerk of the Board [email protected] or mail the same through the U.S. Postal Service to the County, Attn: Clerk of the Board, 175 Fulweiler Avenue, Auburn, CA 95603.

·         All written or emailed public comments received prior to 5 p.m. the day prior to the meeting will be provided to the Board members electronically or in written format.

·         Emails received through the Clerk’s email address above during the meeting will still become part of the record for the Board meeting and retained by the Clerk.

·         The public may always view a live video feed of the meeting online from the comfort/safety of their own home or workplace at www.placer.ca.gov . Closed captioning is available.
