A.    Annexation | Brady Estates Subdivision

1.    Conduct a Public Hearing to consider all protests, if any, to the annexation of the Brady Estates Subdivision property, located on the northeast corner of Baseline Road and Brady Lane in West Placer (APN 473-010-033-000), into the boundaries of County Service Area 28, Zone of Benefit 173 – Dry Creek to provide sewer service, and determine whether written protests to the annexation have been received from a majority of property owners who own more than 50 percent of the assessed value of all taxable property in the proposed zone.

2.    Adopt a Resolution annexing the Brady Estates Subdivision property (APN 473-010-033-000) into County Service Area 28, Zone of Benefit 173 – Dry Creek for sewer service.

3.    Determine that the proposed action is exempt from environmental review pursuant to California Environmental Quality Act Guidelines Section 15319.

A.    Establishment of a New Agricultural Preserve and Williamson Act Contract (PLN22-00414)

1.    Conduct a Public Hearing to consider division of Agricultural Preserve 204 (APNs 031-370-026-000, 031-370-027-000, and 031-370-007-000) to allow for a new 23.3-acre Agricultural Preserve and Williamson Act Contract.

2.    Adopt a Resolution approving Land Conservation Agreement PLN22-00414.

3.    Determine the establishment of Agricultural Preserve and Williamson Act Contract PLN22-00414 Categorically Exempt from environmental review pursuant to Section 15317 (Establishment of Agricultural Preserves) of the California Environmental Quality Act.

A.    Defay Variance - Third Party Appeal of the Planning Commission’s Approval of a Variance - Categorical Exemption (PLN22-00384)

1.    Conduct a Public Hearing to consider an appeal filed by Tyler Field.

2.    Deny the appeal filed by Tyler Field.

3.    Uphold the Planning Commission’s January 12, 2023 approval of a Variance to allow for construction of a 1,077 square foot, two-story, residential addition to an existing single-story residence proposed to be located 28 feet, eight inches from the northwest (side) property line where a minimum of 30 feet is normally required and 25 feet, six inches from the northeast (front) property line where a minimum of 50 feet from edge of easement is normally required.

4.    Find the project Categorically Exempt in accordance with Sections 15303 and 15305 of the California Environmental Quality Act Guidelines and Class 3 – New Construction or Conversion of Small Structures and Class 5 – Minor alterations in land use limitations).

A.    Bereavement Leave

1.    Approve a side letter agreement between the County and the Placer Public Employees Organization to update bereavement leave provisions.

2.    Approve a side letter agreement between the County and the Placer County Law Enforcement Management Association to update bereavement leave provisions.

3.    Approve a side letter agreement between the County and the Placer County Deputy Sheriff’s Association to update bereavement leave provisions.

4.    Introduce an Ordinance, waive oral reading, to amend various sections of Chapter 3 of the Placer County Code related to bereavement leave for all eligible employees.

 

12.  PARKS AND OPEN SPACE

A.    Funding Agreement for Newcastle Elementary School Field Improvements

1.    Approve the use of Park Dedication Fees in the amount of $375,000 from Recreation Area #15, Ophir - Newcastle Area, for the renovation of a play field on the Newcastle Elementary School District property at 645 Kentucky Greens Way (APN 031-241-041) in Newcastle.

2.    Approve a FY 2022-23 Budget Amendment #AM-00796 for CC120085 PJ02098 – Parks & Grounds Capital Improvements in the amount of $525,000.

3.    Authorize the Director of Parks and Open Space or designee to execute an Agreement with Newcastle Elementary School District to provide funding for the Newcastle Elementary School District Play Field Renovation Project.

4.    Determine the proposed action is exempt from environmental review pursuant to California Environmental Quality Act (CEQA) Guidelines sections 15301 (Existing Facilities); 15302 (Replacement or Reconstruction); and 15304 (Minor Alterations to Land).

 

B.    Hidden Falls Regional Park Trails and Open Space Expansion Project – Phase 1: Twilight Ride Access and Parking/Trailhead Project | Approve Plans and Specifications and Authorization to Advertise

1.    Adopt a Resolution to approve the plans and specifications for the Hidden Falls Regional Park Trails and Open Space Expansion Project – Phase 1: Twilight Ride Access and Parking/Trailhead Project, and authorize the Director of Parks and Open Space, or designee, to advertise for construction bids.

2.    Find the actions above consistent with the certified Subsequent Environmental Impact Report for the Hidden Falls Regional Park Trails Expansion Project (State Clearinghouse No. 2007062084) that was adopted on March 8, 2021.

 

13.  PUBLIC WORKS

A.    Sewer Backbone Infrastructure | Agreement with JEN CA Placer Ranch, LLC

1.    Approve and authorize the County Executive Officer or designee to execute the Sewer Backbone Infrastructure Agreement with JEN CA Placer Ranch, LLC, a California Limited Liability Company. 

2.    Approve an allocation of up to $28,000,000 in American Rescue Plan Act Funds to provide JEN CA Placer Ranch, LLC with reimbursement of eligible sewer improvement costs.

3.    Approve a Fiscal Year 2022-23 Budget Amendment #AM-00792 for CC12086 – Environmental Utilities Capital Improvements, PJ02193 in an amount of $28,000,000 and cancel American Rescue Plan Fund (FD13140) in an amount of $28,000,000.

4.    Determine the proposed actions are not considered a project under the California Environmental Quality Act Guidelines Sections 15378(a) and 15378(b)(5).

2.    Authorize the CDRA Director, or designee, to execute service agreements, and any amendments thereto, with Nastich Law, A Professional Corporation, Palacios Law Office, and California Hearing Officers, LLP for Administrative Hearing Officer services in a maximum aggregate amount of $75,600 for the period of March 1, 2023 to February 29, 2024, subject to County Counsel and Risk Management concurrence.

1.    Confirm the proposed appointment of Andrew Ryan to Seat #1 (Business Association) and Vinton Hawkins to Seat #12 (At-Large).

1.    Approve out-of-state travel for Placer County Board of Supervisors’ members, Bonnie Gore and Suzanne Jones, and District Director, Michael Spelis, to attend the Sacramento Metropolitan Chamber of Commerce’s annual Capitol-to-Capitol Program in Washington D.C. Supervisor Jones and District Director Michael Spelis will travel on April 21-26, 2023, and Supervisor Bonnie Gore will travel on April 20-25, and continue to attend the 2023 Wellville Gathering in Spartanburg, SC on April 25-27, 2023.

 

D.    Adoption of Board Direction on District Office Staffing Model

1.    Adopt an Uncodified Ordinance, introduced March 14, 2023, to amend the uncodified Schedule of Classifications and Compensation Ordinance to retitle the District Director Contract and District Assistant Aide Contract and to create a new job title of Board of Supervisors District Representative Contract and associated salary grade UA5.

2.    Adopt an Uncodified Ordinance,  introduced March 14, 2023, to rescind and replace Ordinance 5450-B providing for the appointment of district specific staff for members of the Board of Supervisors.

 

20.  HEALTH AND HUMAN SERVICES

A.    Reaffirm a Local Health Emergency Declaration Due to the Mosquito Fire

1.    Adopt a Resolution to reaffirm a Local Health Emergency Declaration by the Placer County Interim Health Officer due to the immediate public health threat caused by hazardous waste and debris from the Mosquito Fire.

 

B.    Ratification of Donated Gift Cards for Program Use

1.    Ratify the acceptance of donated gift cards for program operations for the public benefit of residents in need in Placer County.

 

C.    Proclamation Declaring April 2023 as "Child Abuse Prevention Awareness Month"

1.    Approve a Proclamation declaring April 2023 as "Child Abuse Prevention Awareness Month" in Placer County.

 

D.    Veterans Advisory Council Bylaws

1.    Approve the Placer County Veterans Advisory Council Bylaws.

2.    Add the Veterans Advisory Council Quarterly meeting to the Board Committees and Commissions list and appoint the District One Supervisor to serve for the 2023 calendar year.  

 

21.  PROCUREMENT - In accordance with County Policy, non-contested competitively awarded bids under $400,000 are placed on the Consent Agenda.

 

A.    Civil Engineering Services | Qualified List

1.    Approve a Qualified List based on the competitive Request for Qualifications No. 20313 for civil engineering services for public works projects, to be provided as needed to the Department of Public Works for the period of March 28, 2023 through March 31, 2025.

2.    Approve the option to renew the resulting Qualified List on a year-to-year basis for three (3) additional one-year periods.

3.    Authorize the Purchasing Manager to sign all required documents.

4.    Make a finding that the requested contract actions are each exempt from California Environmental Quality Act review pursuant to CEQA Guidelines Section 15061(b)(3) and the requested action is not a project pursuant to CEQA Guidelines Section 15378.

 

B.    Environmental Consulting Services | Qualified List

1.    Approve a Qualified List based on the competitive Request for Qualifications No. 20326 for environmental consulting services for public works projects, to be provided as needed to the Department of Public Works for the period of March 28, 2023 through March 31, 2025.

2.    Approve the option to renew the resulting Qualified List on a year-to-year basis for three additional one-year periods.

3.    Authorize the Purchasing Manager to sign all required documents.

4.    Make a finding that the requested contract actions are each exempt from California Environmental Quality Act review pursuant to CEQA Guidelines Section 15061(b)(3) and the requested action is not a project pursuant to CEQA Guidelines Section 15378.

 

C.    Natural Gas as a Motor Vehicle Fuel | Pacific Gas and Electric Company

1.    Approve an amendment to increase contract SCN104814 with Pacific Gas and Electric Company of Sacramento, CA for the purchase of natural gas for compression as a motor vehicle fuel in the amount of $50,000 for a new maximum amount of $270,000 for the period of April 1, 2022 through March 31, 2023.

2.    Approve the renewal of a contract with Pacific Gas and Electric Company in the maximum amount of $270,000, for the period of April 1, 2023 through March 31, 2024.

3.    Approve the option to renew the agreement on a year-to-year basis for three (3) additional one-year periods and authorize change orders up to a maximum amount of $27,000 consistent with Placer County’s Procurement Policy.

4.    Authorize the Purchasing Manager to sign all required documents.

 

D.    Crowdstrike Software Subscription | ePlus Technology Inc.

1.    Approve a contract with ePlus Technology Inc. of Rocklin, CA in the maximum aggregate amount of $458,357.20 for the purchase of Crowdstrike software subscriptions for the period of April 16, 2023 through September 15, 2026.

2.    Authorize the Purchasing Manager to sign all required documents, subject to departmental concurrence and available funding.

 

E.    Accela Consulting Services | TruePoint Solutions LLC

1.    Approve an increase to a negotiated agreement with TruePoint Solutions LLC of Loomis, CA for Accela Consulting Services in the amount of $31,750 for a new maximum amount of $119,950 through September 30, 2023.

2.    Authorize the Purchasing Manager to sign the resulting amendment.

 

22.  PUBLIC WORKS

A.    Intention to Set Public Hearing | Annexation of the 5475 Stanley Drive Property

1.    Adopt a Resolution of Intention to set a public hearing at 9:00 a.m., or as soon thereafter on April 18, 2023, to consider annexation of the 5475 Stanley Drive property, located on the northeast corner of Stanley Drive and Gayle Lane in North Auburn (APN 076-272-014-000), into the boundaries of Sewer Maintenance District 1 – North Auburn to provide sewer service.

 

B.    Battery Electric Bus Facility Design and Specification Services | Agreement with WSP USA Inc.

1.    Authorize the Director of Public Works, or designee, to award and execute an agreement with WSP USA Inc. to perform design and specification services for a Battery Electric Bus Charging Facilities, in an amount of $497,537, subject to Risk Management and County Counsel concurrence, and authorize change orders up to $49,753 consistent with the Placer County Procurement Policy.

2.    Determine that the proposed action is exempt from environmental review pursuant to California Environmental Quality Act Guidelines Section 15301(c).

 

23.  REVENUE SHARING In approving the following appropriations, the Placer County Board of Supervisors makes the finding that each and every approved contribution serves a public purpose by promoting the general welfare of the County and its inhabitants; therefore, the County benefits.

 

A.    A Touch of Understanding, Evening of Insight

1.    Approve appropriation of $2,450 in Revenue Sharing monies to A Touch of Understanding, Evening of Insight as requested by Supervisor Gore ($1,000), Supervisor Landon ($250), Supervisor Holmes ($500), Supervisor Jones ($500), and Supervisor Gustafson ($200).

 

B.    Tommy Apostolos Fund

1.    Approve appropriation of $1,750 in Revenue Sharing monies to Tommy Apostolos Fund as requested by Supervisor Gore ($1,000), Supervisor Landon ($250), and Supervisor Jones ($500).

 

24.  SHERIFF

A.    California Department of Parks and Recreation Division of Boating and Waterways Boating Safety and Enforcement Financial Aid Program Application Superseding Resolution

1.    Adopt Resolution superseding Resolution 2022-231 authorizing the Sheriff, or Sheriff’s designee, to execute the Boating Safety and Enforcement Financial Aid application between Placer County and the California Department of Parks and Recreation Division of Boating and Waterways. Program funding for FY 2023-24 includes State funding in the maximum amount of $72,475 and County boat taxes estimated in the amount of $508,651, for a total of $581,126.

 

B.    Flock Group Inc. Agreement

1.    Approve a two-year agreement with Flock Group Inc. of Atlanta, GA for Automatic License Plate Recognition (ALPR) camera annual subscription licenses, associated software, and professional services for the total amount of $238,600.

2.    Authorize the Purchasing Manager to execute all required documents subject to County Counsel and Risk Management concurrence.

 

25.  SUCCESSOR AGENCY

A.    Housing Successor Annual Report

1.    Adopt a Resolution approving the Fiscal Year 2021-22 annual report of the Housing Successor Agency’s Low and Moderate Income Housing Asset Fund.

Levine Act – Campaign Contributions (Government Code Section 84308)

As of January 1, 2023, the Levine Act (Government Code Section 84308) applies to Board of Supervisors proceedings involving a license, permit, or other entitlement for use.

Pursuant to Government Code Section 84308, no Board Member shall accept, solicit, or direct a contribution of more than $250 from any party or their agent, or from any participant or their agent, while a proceeding involving a license, permit, or other entitlement for use is pending before the County or for 12 months after a final decision is rendered in that proceeding. Any Board Member who has received a contribution of more than $250 within the preceding 12 months from a party or their agent, or from a participant or their agent, shall disclose that fact on the record of the proceeding and shall not make, participate in making, or in any way attempt to use their official position to influence the decision.

 

 

Pursuant to Government Code Section 84308(d), any party to a covered proceeding before the Board is required, and any participant to such a proceeding is strongly urged, to disclose on the record of the proceeding any contribution, including aggregated contributions, of more than $250 made within the preceding 12 months by them or their agent to any Board Member. The disclosure must include the name of the party or participant and any other person making the contribution, if any; the name of the recipient; the amount of the contribution; and the date the contribution was made. The disclosure shall occur in the manner required under Government Code Section 84308 and any applicable state or local regulations, opinions, or policies. No party or their agent, and no participant or their agent, shall make a contribution of more than $250 to any Board Member during the proceeding or for 12 months after a final decision is rendered in that proceeding.

Materials related to an item on this Agenda submitted to the Board after distribution of the agenda packet are available for public inspection at the Clerk of the Board of Supervisors Office, 175 Fulweiler Avenue, Auburn, during normal business hours. All written or emailed public comments received prior to 5 p.m. the day prior to the meeting will be provided to the Board members electronically or in written format. Emails received through the Clerk’s email address above during the meeting will still become part of the record for the Board meeting and retained by the Clerk.
